eFine, an app that will release on the 30th September, was the brainchild of two siblings after they found their bus route was often delayed by cars parked illegally. The founders say the app is a way for “residents to claim back their streets.”
How does it work?
When you spot a parking infringement, you simply open the app, video for evidence and then eFine takes care of the rest.
“The app lets a user know if they are in a partner council area before they record the infringement,” says Alex Mühlhölzl, Chief Operating Officer. “The data is not accessible by the user and is not stored on the user’s phone, it is sent to us and stored on an Azure system, meaning only the council associated with the infringement notice can see the video and decide if a fine should be issued. We don’t even see it.”
With this, you will also get a 25% share of the infringement notice when paid as an incentive and thank you for doing a parking officers job. eFine themselves also keep a 25% share to cover costs.
Who’s going to use it?
“Those that have a disability and get impacted by people parking on the footpath, those pushing buggies or elderly on scooters who have to go into traffic to get around the illegally parked vehicle,” says Alex.
“There is also the issue that some electric vehicles cannot charge because a combustion vehicle has parked in the charge point parking space. With councils investing millions in electric vehicle infrastructure, these charge points generate revenue that offsets this capital cost so every vehicle using it to charge matters.”
How can our councils benefit from it?
Other benefits include better traffic management and identifying risky spots sooner. Councils will also be able to ensure that parking wardens are implementing and inspecting reports from the general public as well as optimising the use of technology, something which some councils lack.
“It addresses the need for better management of traffic flow, vehicle and pedestrian, without the huge costs that are incurred by councils having to hire enforcement staff or outsource the service,” says Alex.
“We have a focus on traffic flow management, cars and pedestrians, and also pedestrian safety, and as such we are looking to prepare a template for councils that are looking to introduce pedestrian zones around schools without the financial burden of installing CCTV networks.” says Alex. “We are also looking to support councils who are looking at the initiative of fining households for leaving rubbish or bins out for days or weeks. This rubbish is often scavenged by animals and creates an environmental problem and bins on the footpaths create pedestrian traffic issues for the disabled and those pushing buggies or trolleys and those on scooters.”
Asking other pedestrians to report and send in images is something that has been trialled before with dashcam footage to some success but creating a CCTV network on mobile phones is a new suggestion and one that poses some questions.
GDPR?
A huge part of GDPR is providing users the tools to control their data, how it is collected and how it is stored.
In all areas where CCTV is filmed or parking wardens operate, a notice is displayed or residents are informed where this is in use through promotional information on websites etc.
However, with this app, no user of a car is going to know that they have been filmed and sent in, which contravenes GDPR. It will be interesting to see how this plays out in the long term.

I think you’ll find it is Law that you cannot block a pavement. If there are no yellow lines / parking restrictions, then you still must allow enough room for pedestrians, prams & wheelchairs etc. This applies to the whole of the United Kingdom.
At the moment, it is only illegal for lorries to stop on pavements outside of the capital, although drivers who park their car in a dangerous position, or cause an unnecessary obstruction to other road users, can still be fined.

Around our police station the parking laws were ignored until complaints from Joe public then parking was altered to a set area for police vehicles and a small area for police operation vehicles. But while doing that yellow lines appeared and covered far more area than it used to do making parking difficult for all.

Parking on the pavement is not illegal, however driving on the pavement is a serious offence. But you need to prove who drove the car there to park it.

a policeman once told me it’s not illegal to park on the pavement. although you’d think it would. apparently its not illegal to block someones drive either (in scotland anyway) unless the car is in the drive and wants out but if they block it and you want in, its tough luck.

It is only illegal to block a vehicles access to the public, not from it. So if there is a vehicle on the drive, don’t park there, but if there isn’t (as long as it’s not in a garage on the drive), it’s not illegal, but it is extremely bad mannered, unless you’ve got the owner’s permission.

UK law is crazy and much of it needs to be revamped. It is not illegal for someone to actually park their car on your drive and worse still you can get in trouble if you try to remove it. Much the same as some property laws. If your kids ball lands in next doors garden they don’t have to give it back but they can’t keep it destroy or give it away. Who wrote all these crazy laws.

It is illegal to drive anywhere other than on the road. It is also an offence to block a pavement, or over a driveway which has got a drop down kerb.. Parking during the hours of darkness also has its regulations. The near side of the vehicle must be parked closest to the kerb. Vehicles over 30 cwt must display lights at all times on a roadway, and, all vehicles must park outwith 15 yards from a junction. Except for 3 cities in England, London, Manchester and Birmingham, it is not illegal to park on the pavement. In fact even in these cities, there are only local bye-laws which control this. There are no National laws

There’s an interesting article on this subject from the RAC on the web, it highlights the grey areas in the law and the distinction between “must not” and “should not” in the highway code. Unfortunately, outside London the highway code only states that you “should not”.

No. He’s right. The legislation only covers London at present. Highway code only advised not to do it elsewhere. Welsh Government has set up a project group to discuss ways to tackle it in Wales.
It is “law” in London but not outside of London.
Highway Code rule 244 has stated that drivers “MUST NOT park partially or wholly on the pavement in London and should not do so elsewhere unless signs permit it.” and the important wording here is “must” and “should”.
In London there is legislation behind the rule but outside of London it is just advisory and there is no legislation to back it up. However, Rule 242 states “You MUST NOT leave your vehicle or trailer in a dangerous position or where it causes any unnecessary obstruction of the road.”, again this is “must”, so is backed by legislation, so if it seen by police and deemed to be dangerous or causing an obstruction you could get a penalty notice.
There is as yet no well publicised definition of sufficient space, and even Building regs for disabled access and SCOPE recommendations vary a little. However, You should be safe with a clear space of 3 feet (approx 900mm). I would like to see this incorporated into the Highway Code.

Drivers park on pavement leaving “a space” but nine times out of ten it is just enough for a body to go through, sometimes sideways, often not enough if you are carrying shopping – a definitely not wide enough for wheelchairs. Hi there,I have a large car parked right outside our front door,front of car over the pavement by about 10,12 inch blocking half the pavement,have z disability and very bad health issues,near fallen 3 times against it if I was in a chair would not get in front door 2 other bays he could use but dose not whats your views please thanks anybody.

Has been an offence since before 1960…….see the Construction & Use Regulations. Footpath parking were bread & butter offences in the 60’s when I was a young constable in Darlington.
I wish we had had digital cameras in those days, as we had to draw an A4 size sketch plan for the Magistrates. We’d have reported many more with a camera.
Read the Highway Code, it has always been the Law that you do not park on the Pavement unless the local council has brought in a local bye law, giving permission to park on the pavement.
@ Michael: The Highway Code is NOT law! I hear this nonsense so many times! Only a portion of it is law and that is clearly stated if you read it correctly. They use the word “MUST” and then quote the specific law involved, otherwise it is NOT law!

Parking on the pavement is only illegal in London. FULL STOP (Unless there is a local Council Bye Law PREVENTING it which is the opposite to what you said).
Driving on the pavement is illegal in the whole of the UK – some say that you have to drive onto the pavement to be able to park onto it – this is true but not typically enforced.
Obstructing users of the pavement is illegal. FULL STOP.
However, though the Highway Code is not law in itself, a Police office can use it in court against you to add strength to support their case and another law.
For example, the code says not to park within 10 meters of a junction but it is NOT illegal and you can not be done for doing so. But an officer can claim that you are causing an obstruction (which is illegal) and/or blocking visibility and endangering other drivers as they turn the corner (which is illegal) by not following the code, so the code strengthens the case.
Please everyone stop guessing or badly interpreting as this does not serve anyone.

This is what the police say about your comments. If not specifically prohibited, parking a vehicle on the pavement could lead to an offence of obstruction being committed – this could result in a fixed penalty notice being issued to offending vehicle/s. … Therefore, it is still against the law to park on the pavement/verge by the side of yellow lines. It is going through parliament at the moment to make it law throughout England.

Reading the other comments, it just shows how out of touch people are. [read the Highway Code]. The law is straight-forward as I have just mentioned….. Con. & Use Regs …….. block a footpath a little, is sufficient for prosecution, eg. front bumper overhanging the kerb, one wheel on the kerb/path.
A fortune can be made if the police walked the beat as I did in my early days [60’s], with the Sergeant or Inspector breathing down your neck. Pity those days are over. Highway Code rule 129 allows you to: “cross the line if necessary, provided the road is clear, to pass a stationary vehicle, or overtake a pedal cycle, horse or road maintenance vehicle, if they are travelling at 10mph (16km/h) or less.”
Outside of our village we have double white lines, sharp bends and oncoming traffic is often hidden. This does not stop people straddling the lines to get past any “slower” traffic, going round the sharp bends on the wrong side, and generally overtaking when vehicles coming the other way, totallt ignorkng the lines! Also we have a police officer living opposite, has no dropped kerb but drives over and blocks the pavement. While workmen at his house, both vans parked completely on pavement, blocking it for a disabled man from using the pavement. Are police exempt!!! Today a van was parked over pavement, into main road ,rear was in road we had to walk in the road to get past! Could make a fortune on this app. Brought this up with Parish Council, they thought it hilarious and not a problem.

Perhaps you need to reread the Highway Code, which for the majority of time is just a code not legally enforceable. Unless there are signs specifically stating not to park on the footpath or verge it is not illegal to do so
Parking on the pavement should not be outlawed – existing regulations should be observed and enforced, so it’s illegal on a double yellow line, otherwise it is only an offence if the pavement is obstructed. Leave enough width for buggies and pedestrians and there is no problem. Going further than that would be using a sledgehammer to crack a nut.
Where I work, everyone parks with two wheels on the pavement. There’s plenty of room to get by, but if we didn’t then large vehicles couldn’t get down the road. For the record, there is nowhere else to park, so we have to do that.

Moving traffic offence. Depends whether it has gone from the police to local council enforcement (like parking, that was essentially decriminalised from offence to contravention) and varies from place to place, but it would remain an offence I think.

What if you “film” a pre-doctored film played back from another phone? You can appear to be in the right place/time with a photoshopped car in an illegally parked position superimposed.

It’s not always clean cut as to whether you have parked illegally sometimes. The council seem to make rules up as they go along where I live.
First of all, I agree with the sentiment of your view. For example, I wish there was a way of preventing people from dropping litter. I once blocked a yellow studded kerb, which is intended for less able-bodiied and partially sighted or blind people to use, and was cross that I had a fine to pay – I didn’t realise at the time that I could be fined as a yellow was not present. I received further education that day when I saw a disabled person in a mobility scooter and it dawned on me that I had potentially prevented someone from making progress on their journey by my selfish action., committed in ignorance. I wouldn’t call either littering or illegal parking a crime per se, but both actions are anti-social, and persistent offenders, like criminals can be the bane of our lives. I have just tried to find a difference between a criminal offence and a civil offence – it is not easy to find a difference from the point of view of the offence committed!
I would like to reiterate that I agree with your opinion and therein lies my dilemma. I feel an aversion to towards those committing crimes, worse “crimes” than those who drop litter or commit traffic violations because they will drag us into a state where our every action is monitored and processed. I spent weeks fighting Bromley Council, who tried, quite incorrectly, to fine me for loading/ unloading on double yellow lines.
They gave up, in the end, but never admitted they were wrong. They got ever more threatening, on a weekly basis, and the whole situation was extremely unpleasant and stressful for me and for Mrs me.
For the record, I’ve not been back to Bromley since, and have no intention of going there, precisely because of this appalling action.

Reminds me of a similar situation that happened close to where I live.A fire engine was called to a house fire close to where a ”lady” had parked in the most inconveinient situation on a quite narrow road,consequently the fire engine couldn’t pass without damaging the parked car – it knocked off the car’s wing mirror.The lady then wrote to the fire service HQ complaining about the damage to her car and demanding that the fire service pay for the repaires and asking for compensation.What she forgot to mention was that when she got home,she was horrified to find that it was her house that the fire engine was rushing to.I heard that there wasn’t a great deal of her house left !!
I recall a most glorious and fond memory of a whole stream of fire engines smashing the heck out of an illegally positioned car that was obstructing them on a blue-light emergency response. One after another, they ploughed into the front or rear of the car, as it was spun around on Woolwich main road. The fire engines showed exactly what should be done.

How will anyone know if a car has been parked on yellow lines for 1 minute, which is acceptable, or 30 minutes. Parking enforcement can only issue a ticket after 4 minutes where i live

Interesting take … do you know how hard it is to obtain a blue badge? I have arthritis in my left knee, both feet and have had 1 operation on the right and 3 on the left, neither of which have had much impact, but apparently I’m not eligible. So being in pain and unable to walk far doesn’t qualify! However, as blue badge holders can park on double yellows, provided that they don’t block traffic, for a limited time I do agree with Janet’s comment about proliferation of blue badge spaces.

I have been disabled for 30 years and without my blue badge and motability car I would be virtually house bound. this is the sort of attitude that we disable folk have to deal with on a daily basis. you are disgusting.

It’s ignorable because it’s unenforceable as the council can’t issue tickets on pictures or short videos alone. It is not illegal to stop on a single or double yellow line in certain circumstances and context cannot be determined from a 10 second video, let alone a still picture. The driver can claim they were loading which is legal for up to 4 minutes (at least)
Apart from with a blue badge or under the direction of a police officer I don’t know any time when it is legal to stop on a double yellow line. Double yellow equals no stopping, waiting, loading or unloading.
Malvin that is wrong. Double yellow allows loading and unloading. To proscribe that too you also need the extra stripes.

had a w space outside her house which able drivers constantly parked in. The council took back policing these spaces from the police, but the council officers only worked 9 till 5. There was no policing overnight or weekend. This app would have been a godsend.
Yes I would download the App. As a new parent I experience many examples of poor parking, forcing me to push my child’s pram into the road. I have recently had a vehicle park across my drive preventing me from being able to go anywhere.
Additionally how would it work in Parent and child spaces in Supermarkets.? The supermarkets do not get involved.
A problem which often arises nowadays is that cars in general are a lot bigger than years ago but parking spaces remain their original size. Supermarkets (other companies / businesses also apply) will not make changes due to cost / inconvenience whilst work takes place but their main reason is they simply want to cram as many customers into their premises as possible.
Wrt disabled or blue badge drivers clarity would need to be made as to what they ARE or ARE NOT allowed to do with their vehicle.
What would be the situation if there is a parking infringement and the driver is in the vehicle? I regularly see a taxi driver parked FULLY on the pavement whilst asleep.

Too right my parents are always being blocked in their own driveway and they paid to have a white line on the road across the drive and still these mothers with 4×4’s park over the white line so my parents can’t get out or into their driveway – complain to the school and they just don’t give a sh1t, I remember when they had a school fete & I was stuck in the driveway so ended up having the registration read out 3x asking for it to be moved and it wasn’t until I took the mic off the compare and said if you don’t move your f-ing car now I will drive into it and leave it in the middle of the road after I’ve smashed all your lights in with my baseball bat you ignorant tw@t!! Funnily enough they came and moved it – didn’t apologise though, made out it was a huge imposition to them – the fact I’d not been able to leave for 2hours – the police weren’t interested when I’d phoned them!!

So if a driver stops due to an emergency within the vehicle or vehicle fault and is photographed are they guilty until proved innocent and what mention of defence procedures has been stated before we all go and download this app to line the pockets of the company who will financially gain from this?
That’s exactly what hazard lights are for. Plus the vehicle will not be left unattended.
There is an appeals process to use under those circumstances, if you can prove that there was a valid reason, such as a breakdown, the ticket will be cancelled.
Would love to download this app, to many lazy parkers who clutter up the kerbside leaving little or no space for wheelchairs , pushchairs/prams or pedestrians to pass safely……

Personally im not a fan of doing a traffic wardens job and snitching on others but just the other day i passed 2 cars bith parked on double yellow lines. And what irked me more was that they were bith really expensive 4x4s. Seem to think they own the road.
They are allowed to – it’s in page 5 of their owners manual !!

Brilliant idea. I used to work for a local council and one of my responsibilities was to improve access for disabled people. Every time I questioned people without a blue badge parked in a disabled parking space outside the council tax offices, I got the same response: ‘It’s only for a few minutes.’ All those ‘few minutes’ often added up to a whole day. Some people are just selfish and lazy.
In America you can be fined up to $800 for parking in a disable bay, why not here
We would need wardens or CCTV (with people to man them) here in order to catch those who who do not have blue badges useing disabled bays .

Great idea. We have cars abandoned in our street frequently, impacting on the already stretched parking areas and causing issues for pedestrians. This will be a very useful tool for contacting the right people to get the vehicles moved and may be a deterrent going forward.
We have plenty of cars on our stretch of road that got No tax, MOT or SORN off the road but our on public road taking up room. It’s sometimes hard to park in front of your own house because of theses idiots. And some park in DISABLED bays that are NOT even disabled. So I totally agree, but. It sure if this will work. As you can report untaxed etc through them which I have down many times but nothing happens .
I think it is a great idea! I would use it and that is not for the money but to get some of these lazy and very inconsiderate owners of vehicles off the yellow lines and allow emergency vehicles through!

Yes I will use it, I am elderly and disabled and am fed up with non badge holders using the spaces, which are at a premium in Witney these days. I am also fed up with not being able to manoeuvre on footpaths due to either bad parking or overgrown gardens impeding on the pavement. What a wonderful idea and I will be ready to download as soon as its available. It hopefully will teach these selfish people, by hitting them in their pocket!

I think this is not before its time. Our local Council struggles with the proliferation of consistent illegal parking offences.
The Idea has some merit but I would feel a lot easier about it if the person taking the photo got NO money for doing it and only got the feeling of satisfaction for doing their civic duty.

Dont you get the feeling, it’s a case of getting the slaves to tell on the other slaves. It worries me how far will people go with this, and more like this to come. Just look at how much harassment parking wordens get. Now think what you or I would get if we are caught by the owner. If you do take this up please be very careful.
